Terms of Service

These Terms of Service govern your use of Forever Competitive ("FC"), including our websites, accounts, organization and facility workspaces, reservations, memberships, programs, coaching, lessons, leagues, tournaments, communications, check-in features, and related platform services.

1. Your account

You must provide accurate information, maintain the security of your credentials, and use your account only as authorized. One FC account may connect you with multiple organizations, facilities, roles, and services. You are responsible for activity performed through your account unless applicable law provides otherwise.

2. Organizations, facilities, and independent operators

Organizations and independent operators using FC may establish their own membership plans, eligibility requirements, prices, guest rules, reservation rules, schedules, approval requirements, safety rules, refund policies, and other operating conditions. FC provides technology that helps them administer those services. Unless FC expressly agrees otherwise in writing, the organization or operator is responsible for its own business, membership, staffing, facility, activity, and customer-service decisions.

3. FC subscriptions and commercial agreements

Organizations or professional users may purchase monthly or annual FC software subscriptions. The package, price, billing frequency, promotional period, first paid billing date, and other customer-specific commercial terms may be stated in an order, registration authorization, Founding Partner Agreement, or other commercial agreement presented during registration or account administration. Those customer-specific terms supplement these Terms. If customer-specific terms directly conflict with these Terms concerning the package, price, promotion, billing schedule, or other expressly negotiated commercial term, the customer-specific terms control for that subject.

Unless different terms are expressly presented and accepted, paid subscription upgrades may take effect immediately and may generate a prorated charge; scheduled downgrades take effect at the next renewal and do not create an automatic refund or credit for the current paid term; and cancellation normally takes effect at the end of the current paid term. A complimentary or promotional period may have its own stated cancellation and first-billing rules.

4. Payment processing and organization-collected payments

FC may use third-party payment providers, including Stripe, to collect payment methods and process FC subscription charges. FC generally does not store full payment-card credentials when the payment provider handles those credentials directly.

Organizations, coaches, tournament directors, and other operators may separately collect membership dues, registration fees, lesson fees, event fees, or other amounts from their customers. Unless FC expressly states otherwise for a particular transaction, those amounts are charged by the applicable organization or operator using its own merchant relationship. FC is not the seller of those underlying activities and does not take a transaction fee merely because FC technology is used to administer them.

5. Nonpayment, grace periods, suspension, and data

If an FC subscription payment fails or becomes overdue, FC may provide a grace period and may suspend paid subscription access if payment is not resolved. Suspension is intended to restrict paid functionality rather than immediately erase organization data. Restoring payment may restore eligible access. FC may retain account, organization, transaction, agreement, and operational records as reasonably necessary for service restoration, legal obligations, dispute resolution, security, and business records.

6. Reservations, programs, coaching, leagues, tournaments, and activities

Availability, schedules, brackets, courts, resources, instructors, opponents, and event conditions may change. Organizations and service providers may establish cancellation, attendance, check-in, guest, safety, weather, scoring, eligibility, and participation rules. You are responsible for reviewing and following the rules applicable to an activity.

7. Check-in, location-assisted features, and communications

Some organizations may use check-in or location-assisted features to help verify attendance or access. FC may also deliver account, reservation, schedule, court, event, billing, security, and other service communications through available channels. You are responsible for keeping contact information current. Delivery timing can depend on third-party networks and providers and is not guaranteed to be instantaneous.

8. Acceptable use

You may not misuse the platform, interfere with its operation, attempt unauthorized access, circumvent permissions or entitlements, impersonate another person, submit fraudulent or malicious information, probe the service for unauthorized purposes, or use FC for unlawful activity.

9. Safety and participation

Sports, fitness, recreation, and other activities can involve risk. FC provides software and does not supervise every activity offered through the platform. Participants are responsible for evaluating their ability to participate and complying with facility and activity safety requirements.

10. Platform availability, integrations, and changes

We may update, improve, replace, suspend, or discontinue platform features and integrations. Some functionality depends on third-party services or networks outside FC’s control. We work to provide reliable service but do not guarantee uninterrupted, error-free, or permanently unchanged availability.

11. Intellectual property and platform license

FC and its platform, branding, software, interfaces, documentation, and original content are protected by applicable intellectual property laws. Subject to these Terms and any applicable commercial agreement, FC grants authorized users a limited, nonexclusive, nontransferable right to use the service for its intended purpose. These Terms do not transfer ownership of FC intellectual property.

12. Account restriction or termination

Access may be restricted, suspended, or terminated for violation of these Terms, unlawful conduct, security concerns, nonpayment where applicable, misuse of the platform, or an organization’s valid membership or access decision. Subscription cancellation and access suspension are governed by the applicable commercial terms and billing status.

13. Disclaimers and limitation of liability

To the extent permitted by law, the platform is provided on an “as available” basis. FC is not responsible for an organization’s or independent operator’s acts or omissions, facility conditions, activity injuries, participant conduct, or disputes between users and participating organizations except to the extent required by applicable law. Nothing in these Terms excludes liability that cannot lawfully be excluded.

14. Changes to these Terms

We may revise these Terms as the platform, commercial model, or legal requirements evolve. When a material change requires renewed notice or acceptance, we may ask you to review or accept the updated version before continuing to use affected services. FC records the legal-document version associated with registration acceptance.
